Terms of Service (ToS)

1. Acceptance of Terms
By accessing and using this website or any services provided, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you may not use the services.

2. Services Provided
We offer photography services, including the delivery of digital images via an online gallery, such as PixieSet. The gallery is provided to you for viewing, downloading, and ordering prints, where applicable.

3. Client Responsibilities
Clients are responsible for providing accurate information and ensuring that any instructions or requests are clearly communicated in writing. Once images are delivered, the client must download and store them within the timeframe provided.

4. Payments and Fees
All payments must be completed as outlined in your contract or invoice. Failure to provide timely payment may result in delayed delivery of services. Prices for prints or additional services will be displayed clearly on the gallery platform. Payment for additional services is due at the time of ordering.

5. Copyright and Usage Rights
All images provided by the photographer are the intellectual property of the photographer. Upon delivery of the digital images, you are granted a non-exclusive, royalty-free license to use the images for personal, non-commercial purposes. The photographer retains full copyright of all images. Commercial use, redistribution, or alteration of the images without prior written consent is strictly prohibited.

6. Client Gallery and Access
Clients will be provided with a unique link and password (if applicable) to access their photo gallery. You are responsible for keeping the password secure. The gallery will be accessible for a specific duration, and after that period, the photographer may remove the images from the platform.

7. Refunds and Cancellations
Due to the nature of digital photography services, refunds are generally not provided once the images have been delivered. Cancellations before the session may be subject to a cancellation fee as outlined in your contract.

8. Limitations of Liability
We will not be held responsible for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the provided services or images. We strive to maintain the highest quality service, but are not responsible for any loss of data, delays, or service interruptions caused by third-party platforms (such as PixieSet).

9. Amendments to Terms
We reserve the right to update or modify these Terms of Service at any time. You will be notified of any changes, and continued use of the services implies acceptance of the revised terms.

10. Governing Law
These terms are governed by the laws of Texas, and any disputes shall be resolved under the jurisdiction of the courts of Bexar County.
